MyRewardPoints Terms and Conditions

By accessing and using this Site, you agree to be bound by the following terms and conditions. These terms and conditions (the "Program Rules") are provided by FT Rewards d/b/a Frosch Rewards & Incentives ("FRI") to govern the use of the MyRewardPoints (the "MRP"). Services provided by the MyRewardPoints Program are additionally governed by any other separate agreement(s) Customer may have with FRI, and any amendments or changes made to these Program Rules.

By accepting and using the MRP, you agree to be bound by these terms and conditions. In these terms and conditions, “you” and “your” means the person who has received the MRP and “we,” “us,” and “our” means FT Rewards, LLC d/b/a Frosch Rewards and Incentives (“FRI”), our successors, affiliates and assigns. These terms and conditions are subject to change without notice and supersede any and all previous terms and conditions.

Redemption Instructions: MRP Award Codes are only redeemable through FRI for FRI redemption options which include, but are not limited to, merchant gift certificates and gift cards, stored debit cards and gift products (“Redemption Options”). You can redeem your MRP by following these simple instructions:
 
• Go to https://myrewardpoints.incentel.com/ and view our up-to-date list of Redemption Options.
 
• Follow the redemption instructions provided on the website to make your redemption selections. Your redemption will be processed within two (2) business days.
 
• Most redemption selections are received within ten (10) to fourteen (14) business days. If you select gift products as your Redemption Option, delivery may take up to four (4) to six (6) weeks. If you do not receive your selection within the time allotted, please contact customer service at 1-866-388-3959.
 
Commercial Transaction: FRI sells the MRP exclusively to businesses (referred to as “Client(s))” for the purpose of rewarding and /or incenting employees, customers and patrons. The value of each reward/incentive is shown on the MRP in points and one point equals one U.S. Dollar in purchasing power. FRI does not sell the MRP to individual consumers. You acknowledge that you have received this MRP in connection with a promotional program and that you have not paid FRI value or compensated FRI in any way for the MRP you have received.
 
Nature of the MRP: The MRP is not legal tender and cannot be used as a method of payment. The MRP is not a contract, agreement or offer for a contract or agreement.
 
The MRP is not a gift card or a gift certificate. The MRP can only be exchanged for Redemption Options equal to the value of the points shown on the MRP, subject to these terms and conditions. The points on the MRP cannot be converted to cash or cash equivalents at any time. A MRP is not refundable.
 
Forfeiture: Each MRP is registered on the date it is sold to Client and on that registration date an expiration date is also established. Unused funds on a redeemed MRP will be forfeited. YOU MUST USE YOUR MRP PRIOR TO THE EXPIRATION DATE SHOWN ON THE MRP OR YOUR POINTS WILL BE FOREFEITED. The expiration date cannot be extended.
 
Redemption Options: Redemption Options may include prepaid debit cards (stored value cards), catalog selections, vacations or movie tickets or other such options as are arranged through third-party merchants from time to time. Redemption Options are subject to change without notice, are only available while in supply and may be delivered to you subject to additional, specified terms and conditions as required by the third-party merchants. You should become familiar with all terms and conditions that apply to each Redemption Option. You understand that all Redemption Options are provided by third-party merchants, FRI disclaims any and all warranties whatsoever including, but not limited to, FITNESS FOR A PARTICULAR PURPOSE or WARRANTY OF MERCHANTBILITY with regard to such goods and services and that any disputes regarding the goods and services shall be directed to the manufacturer or third-party merchant provider. If a Redemption Option is discontinued, reasonable efforts will be made to offer a substitute of equivalent quality.
 
Limitations: FRI is not responsible or liable for a MRP that is lost, damaged or stolen. FRI is under no obligation to re-issue a MRP that has been lost, damaged or stolen. Reissuance of any MRP is subject to terms and conditions. Expired MRPs cannot be reissued past October 31, 2023.
 
General: All interest earned on the value of any MRP received from a Client prior to redemption shall be the sole and exclusive property of FRI. These terms and conditions will be governed by the laws of the State of Texas, without regard to conflict of law principles. Whenever possible, each provision shall be interpreted in such a manner as to be effective and valid under applicable law, but if any provision is held to be invalid, illegal or unenforceable under any applicable law or rule, the validity, legality and enforceability of the other provisions herein will not be affected or impaired thereby. These terms and conditions, or any portion thereof, shall be subject to applicable law and VOID WHERE PROHIBITED BY LAW.
 

 

Special Provisions Applicable to Method of Payment: Making Purchases with Your
personal VISA, MasterCard or Discover
 

When you confirm a credit card transaction on incentel.com, you agree to be bound by and pay for that transaction. You are responsible for maintaining the security of your account, and you understand that you will be charged for any orders placed on or through your account.

When you provide a credit card payment to us, you confirm that you are permitted to use that credit card. When using a credit card, the card must be in the name of the person ordering. When you make a credit card payment, you authorize us (and our designated payment processors) to charge the full amount to the credit card for the transaction. All transactions are in US dollars.

You agree to be bound by any rules your credit card issuer requires for pre-authorized credit card charges. If you pay by credit or debit card, we may obtain a pre-approval from the issuer of the card for an amount up to the amount of the purchase. We will bill your card at the time of purchase or shortly thereafter. If you cancel a transaction before completion, that pre-approval may result in your funds not otherwise being immediately available. If you cancel an order before an item ships, that pre-approval may result in your funds not otherwise being immediately available.
 
Products sold through this Web site are serviced and supported exclusively by their manufacturers in accordance with the terms and conditions packaged with the products. The Payment Terms in place at the time you confirm a transaction will govern that transaction. We may cancel any transaction if we believe the transaction violates these Payments Terms or we believe doing so may prevent financial loss. We may contact your payment source issuer, law enforcement, or impacted third parties (including other users) and share details of any payments you are associated with if we believe doing so may prevent financial loss or a violation of the law.

If you purchase rewards and your payment method fails, we will cancel the transaction. You may be presented with additional terms related to a specific purchase (such as travel certificates). Those additional terms will also govern that transaction. Your only remedy for a technical failure or interruption of service is to request that your transaction be completed at a later time.It is your responsibility to remit any taxes that apply to your transactions. You agree to indemnify and hold us harmless from and against any claim arising out of your failure to do so. Travel rewards, gift card/certificate rewards, and other non-merchandise rewards are considered fully redeemed once issued and no refunds, credits, or substitutions will be made. If you pay by debit card and your payment results in an overdraft or other fee from your bank, you alone are responsible for that fee. We reserve the right to apply a requirement for a minimum number of Points to be used when using a credit card.

Loss Claims
You agree to wait a reasonable amount of time for items to be delivered before initiating an inquiry. Carriers (e.g. USPS, FedEx, UPS) may not allow us to start an investigation for a lost package until a certain number of days elapses.

Disputes and Reversals
If you believe that an unauthorized or otherwise problematic transaction has taken place under your account, you agree to notify us immediately. If you believe your bill contains any incorrect charges you must notify us in writing of such disputed charges within thirty (30) days of the first bill on which the charge first appears or they will be deemed acceptable by you for all purposes, including resolution of inquiries made by your card issuer.

We agree to work together in good faith to resolve any billing disputes. Your dispute must include sufficient facts for us to investigate your claims and be received by us at least 5 days prior to the Due Date (Dispute Deadline). You waive your right to dispute any charges if you fail to meet the Dispute Deadline. If we find that your claim is valid, we agree to credit the account that is the subject of the dispute on your next bill.

You are responsible for and agree to reimburse us for all reversals, charge-backs, claims, fees, fines, penalties and other liability incurred by us (including costs and related expenses) that were caused by or arising out of payments that you authorized or accepted.

Except as otherwise stated, you must send notices to us relating to payments and these Payment Terms by postal mail to: Frosch Rewards & Incentives, Attention: Legal Department, 5200 S Colony Blvd #560667, The Colony, TX 75056.

Your credit card issuer agreement governs your use of your designated card in connection with the Points + Plastic module, and you must refer to that agreement and not this agreement with respect to your rights and liabilities as a cardholder.

Changing Your Credit Card Information
Once you place an order with us, you will be unable to change your credit card information. We ask that if you need to do this, that you cancel your current order and create a new order with the different credit card information. Most orders may be cancelled up to the time they are processed and shipped.

U.S. Sales Only
When using a credit card, we ship products only within the continental United States. No shipments can be made to APO addresses, United States territories, or addresses outside the United States.


Notices and Amendments to These Payments Terms
We reserve the right to amend these Terms and Conditions from time to time without notice and at our discretion. It is your responsibility periodically to review this page for updates to these Terms and Conditions, which shall come into effect once posted.
